1. General Provisions

This digital platform www.clearmymind.com (referred to as "Platform/website") is operated by MGM International Group a company incorporated under Indian corporate law, headquartered at 3rd Floor, Project Office, People's Mall, Ayodhya Bypass Road, Bhanpur, Bhopal-462037.

By accessing this Platform, you confirm that you have read and understood these Terms of Service ("Agreement") and agree to be bound by them, along with our Privacy Notice and Return Policy. This Agreement governs your relationship with our Platform and associated services. If you do not accept these terms, please discontinue use immediately.

2. Key Definitions

"Organization" means Clear MyMind "CMM", "www.clearmymind.com", including references to "we," "us," "our," or "service operator" - all referring to MGM International Group.

"Customer" means "individual," "participant," "you," "your," or similar terms referring to anyone using our Platform to access services and resources.

[Per applicable terms herein, a Customer may include a Parent/Guardian of a minor (13-17 years) where the Parent/Guardian has full knowledge of services and has authorized the minor to receive services under their direct supervision and consent].

"Professional" means "Mental Health Specialist," "Wellness Practitioner," "Behavioral Health Expert," "Wellness Consultant," "Counseling Professional," "Life Coach," "Advisor," "Specialist," "Clinician," "Guidance Counselor," or similar terms referring to service providers.

3. Service Description

Clear MyMind operates as a digital mental wellness and comprehensive health platform enabling Customers to connect with verified Professionals (approved by Clear MyMind for service delivery through our Platform, including corporate wellness and educational institution programs). All Professionals maintain current licensing and credentials displayed on their profiles.

Clear MyMind Platform features include (but are not limited to):

  1. Digital counseling sessions with licensed Professionals (approved by Clear MyMind for service provision)
  2. Self-evaluation tools and assessments
  3. Educational seminars and training sessions conducted by Professionals
  4. Participation in community forums, discussions, feedback systems, and content sharing
  5. Face-to-face sessions at affiliated clinic locations

All services comply with our confidentiality protocols and privacy standards (see Privacy Notice).

We reserve the right to modify, update, add, or discontinue any service offerings without advance notice.

These shall collectively be referred to as "Services" provided by the Organization through the Platform.

4. Important Disclaimers

Clear MyMind is not equipped to handle psychiatric emergencies or crisis situations. If you or someone you know is contemplating suicide, self-harm, or exhibiting signs of severe mental health conditions, immediate professional intervention is required.

In such circumstances, please contact your local emergency services or visit the nearest medical facility immediately.

5. Customer Eligibility

To access and use Clear MyMind Services, you must be at least 18 years of age and legally capable of entering contracts under Indian law, specifically the Indian Contract Act, 1872, with full capacity to make independent decisions regarding service utilization.

Minor Services: For services provided to individuals aged 13-17 years through their parent/guardian ["Minor"], Parental or guardian consent is required for service access. You confirm as the consenting parent/guardian that you have exclusive authority to provide such consent for therapeutic services through our Platform.

You also consent to our Privacy Notice provisions regarding collection, processing, and use of personal information for the Minor's service delivery. This consent remains valid until service completion by the Minor and/or their parent/guardian.

This Agreement becomes effective upon your first use of Services through the Platform or any related resources. Service access through any device (mobile, desktop, tablet, etc.) is subject to this Agreement.

6. Service Delivery Framework

As Platform operator, our role is strictly limited to facilitating connections between you and Professionals for service provision.

You acknowledge that our Services supplement but do not replace in-person counseling or medical examination. You should not rely solely on information or counseling received through our Platform for health and wellness decisions. No content on our Platform guarantees that any specific treatment or approach is suitable, safe, or effective for your particular situation.

We enable communication between you and Professionals through our Platform. We disclaim all responsibility for any Professional's advice, consultation, or recommendations provided during sessions or other Platform interactions.

Information provided during registration (directly or through your organization) must be truthful, accurate, complete, and current. You agree to maintain this information's accuracy and accept full responsibility for its correctness.

Platform use is restricted to personal use only. Commercial or other non-personal use is prohibited.

You are responsible for maintaining confidentiality of your login credentials and account security information ("Account Security") for Platform access.

Service access requires payment of applicable fees for selected services.

We reserve the right to take necessary actions regarding Platform services and your account information.

You agree to verify technical requirements before using Platform services and ensure your device has necessary software and settings.

You agree not to seek or request personal information or contact details of any Professional or other Platform users during or after service use.

You agree not to use the Platform for:

  1. Unsolicited communications, advertisements, or commercial promotions
  2. Malicious software or harmful code
  3. Unlawful, harassing, abusive, offensive, vulgar, obscene, racist, harmful, or threatening content
  4. Content infringing third-party intellectual property rights (including copyright, trademark, patent, trade secrets, or other proprietary rights)
  5. False or misleading information

You accept full liability for all Platform activities and interactions under your account.

You agree not to interfere with, disrupt, or attempt unauthorized access to our systems, services, networks, or infrastructure.

You agree to comply with all applicable Indian laws when receiving services.

You consent to receive customer communications via SMS and email, with SMS deemed received when submitted to mobile operators.

You consent to receive commercial and transactional messages from Clear MyMind.

7. Professional Services

We make no guarantees regarding service relevance, usefulness, accuracy, or satisfaction. While we maintain quality standards for Professional enrollment regarding qualifications and experience, we advise you to verify Professional credentials before booking services. We do not guarantee verification of Professional skills, degrees, licenses, or backgrounds. You should independently verify Professional credentials before service use.

We are not a medical facility or healthcare provider. Our Platform serves as a connection medium between Customers and Professionals across India & Globe.

Your Professional interactions are at your discretion. We are not involved in service delivery by Professionals.

Payments for services go to Professionals. We may charge Professionals platform usage fees. However, payment processing does not make us service providers.

If you receive files or documents from Professionals, scan them for viruses before opening.

Professional services are based solely on information you provide during sessions. Professional responses are their own, not the Organization's.

Professionals may determine our services are inappropriate for your needs and decline to provide services.

You acknowledge that counseling benefits cannot be guaranteed.

Professionals are independent contractors, not employees. No agency, employment, franchise, or partnership relationship exists between Professionals and the Organization.

8. CMM Digital Wallet

You receive a CMM digital wallet upon successful registration ("CMM/e- Wallet").

You may add funds via credit/debit cards, net banking, or UPI. Prepaid cards, virtual cards, EMI options or card combinations are not accepted. Wallet funds are non-refundable except as specified.

Wallet withdrawal is not permitted. Wallet credit must be used only for legitimate Platform transactions.

CMM wallets are non-transferable.

Monthly wallet limit is INR 50,000 (including credits and refunds). Wallet balance cannot exceed this limit. Limits may change without notice.

We may suspend/discontinue wallet services for:

  1. Terms violations
  2. Documentation discrepancies
  3. Fraud prevention or security threats
  4. Technical issues or maintenance
  5. Transmission problems
  6. Mobile connection issues
  7. Other legitimate purposes

Wallet funds are non-refundable and must be used for legitimate transactions only. No interest is paid on wallet balances.

One wallet per Customer only. Multiple wallets result in registration suspension.

Wallet availability depends on active mobile/internet connections and compatible devices.

Ensure sufficient wallet funds before transactions.

You are responsible for password security and unauthorized wallet use.

Wallet information may be shared with affiliates or third parties for service facilitation.

We may disclose wallet information to authorities as required.

Erroneous transfers are non-refundable.

Our records are conclusive evidence of wallet transactions.

Cashback, credits, and rewards added to wallets are non-refundable.

9. Wallet Validity

Transaction payments are automatically debited from your wallet. We do not endorse goods/services purchased with wallet funds.

Wallets remain active continuously. However, unused funds are forfeited after 12 months of inactivity.

10. Referral Program

Referral programs are available to registered Customers only. Participation is voluntary.

Referral benefits are provided only after the referred person's first completed service. The referred person's email must be new to our Platform.

Referral values are based on current program terms. We reserve discretion regarding referral benefits to prevent fraud.

Additional terms may apply (minimum values, usage periods, etc.). Terms may change with notice.

Referral codes cannot be duplicated, sold, transferred, or made publicly available.

The program rewards loyal customers and is not for public distribution through any media.

We may revoke referral benefits or suspend accounts for code misuse.

Maximum referrals per Customer: 10.

Referral benefits cannot be combined with other codes.

Referral codes are non-transferable with no cash value.

Referral benefits cannot be combined with other offers.

Each referral code is single-use only.

Referral benefits are added to your wallet and are non-refundable.

11. Digital Prescription Service

This feature provides medication and treatment information including:

  • Manufacturing components and ingredients
  • Potential side effects and reactions
  • Alternative treatment options
  • Symptom-related medication information

Customer Guidelines:

Digital prescription information is not a substitute for professional medical advice. This India-specific content may not apply elsewhere. Clear MyMind is not responsible for content applicability outside India.

Information is provided "as is" without guaranteeing accuracy or completeness. Clear MyMind acts as a connection platform only and disclaims liability for information accuracy, errors, or omissions.

Content comes from open sources and third-party platforms. Medication information does not constitute treatment recommendations. Always consult healthcare professionals before making treatment decisions.

Professional Guidelines:

Professionals acknowledge that Clear MyMind does not guarantee information accuracy or legitimacy, including Customer-provided details during consultations.

This feature provides information only, not prescription databases, and does not warrant content validity or applicability. Information is not a substitute for clinical judgment.

We do not guarantee information will meet Professional requirements or expectations.

Disclaimer:

Digital prescription content has not been evaluated by the Drug Controller of India or other regulatory bodies.

Information is provided "as is" without warranties. We disclaim all warranties and liability for any consequences of information use.

Modifications:

Medication references may change based on applicable laws or medical updates without notice.

Liability Limitation:

Feature use is at your own risk. We are not responsible for decisions based on this information.

Users, Professionals, and all parties release us from claims arising from information use.

12. Privacy Notice

Our internet-based services are subject to our Privacy Notice, available on our Platform. Please review it carefully.

13. Cancellation & Return Policy

Online service cancellations and returns are governed by our Cancellation & Return Policy, available on our Platform. We may modify this policy without notice.

14. Community Forums and Content Submissions

Content submitted to us (contest entries, comments, suggestions, ideas) grants us unlimited rights to edit, copy, publish, distribute, and use in any format.

We are not required to:

  1. Maintain submission confidentiality
  2. Provide submission compensation
  3. Respond to submissions

Therapy session communications remain confidential per applicable laws.

Submissions must not infringe third-party rights or contain harmful content. Misrepresenting identity or content source is prohibited. You are responsible for submission accuracy.

We may monitor or remove inappropriate content but are not obligated to do so.

Community posts reflect individual opinions, not Organization views.

15. Service Modifications and Termination

We may modify, suspend, or discontinue Platform services without notice and are not liable for resulting losses.

We may restrict or terminate your access at our discretion without justification.

Uninterrupted or error-free service is not guaranteed due to technological dependencies.

16. Intellectual Property

All Platform content (text, logos, videos, trademarks) is protected under Indian intellectual property law. We retain full Platform ownership.

Platform use does not transfer ownership rights. All content remains our exclusive property.

17. Usage License

You receive a limited, non-exclusive, non-transferable license for personal, non-commercial Platform use. Content modification, distribution, copying, or public display is prohibited unless expressly permitted.

18. External Links

Our Platform may contain third-party links. We do not endorse or take responsibility for external sites, content, or services. Third-party interactions are at your own risk.

19. Errors and Inaccuracies

Platform content may contain errors or omissions. We reserve the right to correct errors without notice, including post-purchase corrections. We are not obligated to update information unless legally required.

20. Liability Disclaimer

Platform use is at your own risk. We provide no warranties regarding suitability for specific purposes.

Our Platform facilitates Professional access only. Professionals maintain full responsibility for their services, advice, and treatment decisions.

We are not liable for Platform use issues, service problems, or Professional interactions. You agree to hold us harmless from Professional service claims.

We do not guarantee Platform security or error-free operation. Content may not apply outside India.

21. Liability Limitations

We are not liable for indirect, incidental, or special damages, including health or life impacts. Total liability cannot exceed fees paid for specific services.

Service-related claims must be made within three months or are waived.

In harm risk situations, confidential information may be disclosed per legal obligations. This provision survives agreement termination.

22. Communications

Notices are sent via registered email, postal mail, or Platform posting. Communications are deemed received on issue date. Contact us at: support@clearmymind.com.

23. Indemnification

You agree to indemnify us against claims arising from:

  • Platform and Service use
  • Terms violations
  • Account-related activities
  • Third-party rights violations

We may assume exclusive defense, and you agree to cooperate accordingly.

24. Terms Modifications

We may change these Terms at any time. Continued Platform use implies acceptance of updates. Latest revision date is noted at document end.

25. Severability

If any term is invalid or unenforceable, remaining terms remain valid. Liability limitations and indemnification survive agreement termination.

26. Complaint Resolution

Per the Information Technology Act, 2000, we have established a complaint mechanism. Contact our Complaint Officer at: support@clearmymind.com. We aim to resolve issues within one month of complaint receipt.

27. Governing Law

All Platform and Service disputes are governed by Indian law under exclusive Bhopal court jurisdiction.
